Misleading Ads Are Prohibited And Action Can be Taken Against Advertiser
We might have bumped into some advertisements where you don’t get what you see and it is always so frustrating. According to the Ministry of Domestic Trade and Consumer Affairs, this advertiser can employ a technique called exaggeration or puffery which is prohibited.
As misleading ads in the advertisement are now not allowed to magnify or exaggerate their products. They are also not allowed to make advertisements where their products or services do not look as advertised.
As an example, they gave this comparison of a burger where they said that it was fake advertising and will confuse consumers. The Ministry has also warned that they can take actions against advertisements that are confusing, deceiving, or gives a false representation and unfair practices under the Consumer Protection Act 1999 and Trade Descriptions Act 2011.
