Federal Courts Declares Selangor’s Syariah Law Against Unnatural Sex is unconstitutional
In the past, the LGBTQ community in Malaysia as the Federal Cort decided today that the Selangor’s Syariah Law has unnatural sex is unconstitutional where The Federal Court declared that §28 of the Syariah Criminal Offences (Selangor) Enactment 1995 is inconsistent with the Federal Constitution, and is therefore void.
By declaring the law unconstitutional it means that the law will have no legal effect in Selangor which means the JAIS (Jabatan Agama Islam Selangor) will no longer have the authority to use that law to conduct raids, arrests or charge anyone under the law. As in the past, where a man challenged the provision that he was charged under for allegedly attempting to commit unnatural sex and the man were charged with unnatural sex with eleven men in a house in Selangor on 9 November 2018.
